TERMS AND CONDITIONS
These Terms and Conditions set out the rules for making purchases in the online store operated at www.annabera.com. The operator of the store is Anna Bera The Whole Elements, based in Lechów, who holds the exclusive right to operate this store. The provisions of these Terms and Conditions are binding for the Seller and all Customers placing and purchasing products through the online store www.annabera.com.
1. GENERAL PROVISIONS
1.1 DEFINITIONS

Terms and Conditions – these regulations governing purchases made in the online store at www.annabera.com;

Store – the online store operated at annabera.com;

Seller – Anna Bera The Whole Elements, located at Lechów 104D, 26-004 Bieliny, NIP (Tax ID): 6572745804, REGON: 260776928, e-mail: anna@annabera.com;
-
Customer – a natural person, legal entity, or organizational unit without legal personality that has placed an order in the online store www.annabera.com;

Product(s) – wall mirrors designed and handcrafted by Anna Bera;

Applicable Law – includes, among others:
-
the Polish Civil Code of 23 April 1964 (Journal of Laws 1964 No. 16, item 93, as amended);
-
the Consumer Rights Act of 30 May 2014 (consolidated text: Journal of Laws 2020, item 287, as amended);
-
the Personal Data Protection Act of 29 August 1997 (consolidated text: Journal of Laws 2002 No. 101, item 926, as amended).

1.2 INFORMATION ABOUT PRODUCTS
-
All Products offered in the Store are new and protected by copyright.
-
Products are handmade or hand-finished.
-
They are produced in unique designs, as well as in limited and unlimited series.
-
Various materials are used in production – including different types of wood, mirror-polished stainless steel or other metals, natural waxes, and technical elements made of PLA (polylactide).
-
Due to the handmade nature of the Products and the use of natural and non-standard materials, the Seller reserves the right for minor variations between items of the same design.
-
Differences between a photographed Product displayed in the Store and another item of the same design ordered by the Customer may occur and are a natural result of the artisanal production process.
-
The Seller also reserves the right to slight color variations between the Product image and the actual Product.
-
Photos and visual representations in the Store are for informational purposes only and do not reflect the actual size of the Products.

The Seller informs that, due to the artisanal nature of the Products and the delicacy of the materials used, they should be used exclusively in accordance with their intended purpose and stored in a manner appropriate to their properties. The Products must not be exposed to mechanical or chemical damage; they must not be cleaned with chemical agents; they should not come into contact with water, alcohol, corrosive substances, solvents, or dyes. Due to the use of mirror-polished metal surfaces that are sensitive to scratching, particular care should be taken when handling and cleaning the objects. The mirror surface should only be wiped with a soft, high-quality microfiber cloth, such as one intended for cleaning eyeglasses or camera lenses.

Complaints arising from a lack of understanding of the Products’ nature or from failure to follow the care instructions described above will not be accepted.
1.3 PRICE
-
All Product prices in the Store are listed in Polish zloty (PLN) and euros (EUR), and are gross prices including VAT.

Prices do not include shipping costs.

The Seller reserves the right to change Product prices, conduct or cancel promotional campaigns, and modify offers at any time.

The price displayed at the time of the Customer’s order is binding for both parties.
1.4 PROMOTIONS
-
A “promotion” refers to the sale of Products on more favorable terms than standard Store prices.
-
Promotions cannot be combined with other offers unless expressly stated otherwise. The Customer may participate in only one promotion at a time, unless the promotion rules specify otherwise.
2. ORDER PLACEMENT
-
The Seller conducts sales of Products online.
-
Information about Products available in the Store does not constitute a commercial offer under the Civil Code, but merely an invitation to conclude a contract.
-
To purchase a Product, the Customer submits an offer to buy by filling out the online order form.
-
The sales contract is considered concluded once the Seller confirms acceptance of the Customer’s offer.
-
After placing an order, the Seller sends an order confirmation email to the address provided by the Customer.
-
Due to the unique nature of the Products or limited material availability, the Seller reserves the right to decline an order before a sales contract is concluded, in which case the Customer will be notified immediately.
-
In special cases, the Seller may limit available payment methods or require prepayment before processing the order, which will be communicated to the Customer in advance.
-
Orders are shipped to addresses within Poland and to selected foreign countries.
3. ORDER FULFILLMENT TIME
-
The order fulfillment time (i.e. preparation of the Product for shipment) is up to 8 weeks from the date of contract conclusion, unless otherwise specified in the Product description.
-
Orders placed after 3:00 p.m. on business days, or during weekends and public holidays, will be treated as placed on the next business day.
-
For electronic or card payments, order processing begins after payment confirmation by the payment operator.
-
In exceptional cases, for example when the ordered Product is not currently available, the Seller may propose an extended order fulfillment period. The Seller will inform the Customer of the anticipated fulfillment time in the email confirming that the order has been accepted for processing. If the Customer does not accept the new fulfillment period, they have the right to cancel the order without incurring any costs, within two business days from receiving the email from the Seller. Failure to confirm acceptance within the above period will be considered a cancellation of the order. Business days are understood as weekdays excluding Saturdays, Sundays, and public holidays.

Products are shipped via courier services or InPost parcel lockers.

Shipping costs are borne by the Customer.
-
International shipping costs depend on the destination country.

International shipping costs depend on the destination country and are specified individually in the order confirmation email.
4. PAYMENT METHODS
The Store offers the following payment options:

The transfer title must include the order number, Customer’s name, and Product name.
Orders are processed once payment is credited.
If payment is not received within 10 calendar days, the order will be canceled.

Credit or Debit Card
Payments are processed in real time via Stripe Technology Company Limited, One Wilton Park, Wilton Place, Dublin 2, D02 FX04, Ireland. -
Google Pay / Apple Pay
Payments processed via Google Pay or Apple Pay integrated with Stripe.
5. RECEIPTS, INVOICES, AND PROOF OF PURCHASE

Proof of sale includes:
-
the order confirmation email,
-
payment confirmation (e.g. bank transfer or online payment report), and
-
a fiscal receipt or VAT invoice (upon request).
-
-
To receive a VAT invoice, Customers must indicate this when placing the order.
-
For registered sales using a cash register:
-
business Customers requesting an invoice must provide their Tax ID (NIP);
-
a receipt with a NIP number up to PLN 450 (EUR 100) is considered a simplified invoice;
-
if a NIP is not provided before issuing a receipt, the Customer is treated as a consumer.
-

The Seller may send invoices or receipts electronically, unless the Customer requests otherwise.
6. DAMAGED SHIPMENTS
-
Before signing for a package, the Customer should check whether it shows any signs of damage or tampering.
-
If the packaging of the shipment shows signs of damage or prior opening, the Customer has the right to refuse delivery and, if possible, to draw up a damage report in the presence of the courier. The Customer should then immediately notify the Store of this fact.
7. WITHDRAWAL FROM THE SALES CONTRACT AND RETURNS
-
In accordance with the Consumer Rights Act of 30 May 2014, the Customer may withdraw from the sales contract within 14 days of receiving the Product, without giving a reason.
-
Withdrawal may concern all or part of the purchased Products.
-
To withdraw, the Customer must send a clear statement via email to anna@annabera.com or through the Store’s contact form.
-
The Seller will confirm receipt of the withdrawal via email.
-
In the event of withdrawal, both parties must return what they have received.
-
The Seller will refund payments, including delivery costs (except for additional costs due to non-standard delivery methods), within 14 days of receiving the withdrawal notice.
-
Refunds may be withheld until the Seller receives the returned Product or proof of shipment.
-
The Customer must return the Product within 14 days of submitting the withdrawal, at their own expense, to the address provided by the Seller.
-
The Customer is responsible for any reduction in the Product’s value resulting from improper use.
-
Withdrawal rights do not apply to Products made to individual specifications or custom orders marked as “made to order”.
-
The Seller does not accept cash-on-delivery returns.
8. COMPLAINTS
-
A Customer who, within two years from the date of delivery of the Product, detects a defect or lack of conformity with the contract, is entitled to avail themselves of the remedies provided by the provisions of the Civil Code (Journal of Laws of 2023, item 1610, as amended) and the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2023, item 2759).

Complaints should be submitted by email to: anna@annabera.com.

The complaint should include:
-
Customer’s name (or company), contact details, correspondence address,
-
Product concerned, description of defect (with photos if possible), date of discovery, and Customer’s request.
-
-
The Seller will collect the defective Product from the Customer at no cost.
-
Complaints are reviewed within 14 days of receipt; failure to respond within that period implies acceptance.
-
If a defect is confirmed, the Customer may request:
-
replacement of the Product,
-
repair of the Product,
-
price reduction, or
-
contract withdrawal (for significant defects).
-
-
The choice of the remedy shall rest with the Customer. The Seller may propose an alternative solution, in accordance with applicable law, considering the nature of the defect, the feasibility of repair or replacement, and the proportionality of the costs.
-
If the defect appears within one year of delivery, it is presumed to have existed at the time of delivery.
-
If the defect results from improper use or storage, the Seller will inform the Customer of the estimated repair cost. The Customer is not obliged to accept it.
11. PRIVACY POLICY
The rules for processing Customers’ personal data are specified in the Privacy Policy available at www.annabera.com/polityka-prywatnosci.
12. FINAL PROVISIONS

The Seller reserves the right to transfer, in whole or in part, rights and obligations related to the Store’s operation, without prejudice to Customers’ rights.

The Seller may amend these Terms and Conditions. Changes take effect upon publication and do not apply to orders placed before that date.
-
Customers who do not accept the new Terms and Conditions should stop using the Store and notify the Seller. In such cases, their account may be deleted.
-
Both the Seller and the Customer will strive to resolve disputes amicably. In the absence of agreement, disputes will be settled by the competent common court in accordance with Polish civil procedure law.
-
For matters not regulated by these Terms, the laws of the Republic of Poland and European Union law shall apply.
